Terms of Service

These Terms of Service ("Terms") govern your access to and use of Nexarticle ("Nexarticle", "we", "us"), available at https://nexarticle.ai (the "Service"). By creating an account or signing in, you agree to be bound by these Terms.

1. Account

You must be at least 13 years old (16 in jurisdictions where applicable) to create an account.
You are responsible for all activity under your account and for keeping your credentials secure. Notify us immediately at contato@ostops.net if you suspect unauthorized access.
You may create an account using an email + password, or by signing in with Google. Either method results in the same account and the same Terms apply.

2. Plans, Billing, and Quotas

Paid plans are billed in advance on a monthly or annual cycle via Stripe. Plan changes take effect at the next billing cycle unless otherwise stated.
Each plan includes a monthly word and image allowance. Usage beyond the allowance is blocked until the next cycle or until you upgrade.

3. Acceptable Use

You agree NOT to use the Service to:

Generate content that infringes intellectual property, includes personal data of others without consent, defames real individuals, or violates applicable law.
Generate sexual content involving minors, content depicting real violence against real people, or content designed to facilitate physical harm.
Attempt to bypass usage quotas, reverse-engineer the Service, scrape protected endpoints, or interfere with other users.
Resell raw access to our AI providers via Nexarticle (i.e. use the Service as a thin pass-through API for third parties).

We reserve the right to suspend or terminate accounts that violate this section, with or without notice depending on severity.

4. Your Content

You retain ownership of the prompts you submit and the AI outputs generated for your account.
You grant Nexarticle a limited license to process your prompts and outputs solely to provide the Service (e.g. to forward prompts to AI sub-processors, store outputs in your workspace, and display them back to you and your workspace members).
We do not use your prompts or outputs to train our own models, and we do not share them with third parties except the sub-processors listed in our Privacy Policy.
AI-generated content can contain inaccuracies. You are responsible for reviewing outputs before publishing them.

5. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, upstream-provider outages, and force-majeure events may cause temporary unavailability. We will attempt to announce planned downtime via in-app notice or email.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXARTICLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXARTICLE'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST REVENUE OR LOST DATA).

8. Termination

You may delete your account at any time from Settings → Account.
We may suspend or terminate your access for material breach of these Terms, non-payment, or activity that poses a security risk.

9. Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of São Paulo, SP, Brazil, unless local law requires otherwise.

10. Changes

We may update these Terms from time to time. Material changes will be announced in-app and via email. Continued use of the Service after a change constitutes acceptance of the updated Terms.
